Who Is A Notary Public?

Indian Law says that a Notary Public also called a Notary is an individual who is certified to carry out certain legal duties, is said to be formalities or maybe activities. All this adds up with drawing up or validating contracts, deeds, and all other similar legal papers/documents.

The basic task of a Notary Public is to perform as an unbiased observer while removing fraud hindrance exercises linked to legal documents. This act is called notarization.

The Union Government, for the entire or some part of our country, and any State Government, for the complete or any part of the State, may delegate any licensed practitioners or different personalities as notaries, who hold such essentials as may be guided (Section 3 of the Act).

Services Of A Notary Public of India

Following the Notaries Act, 1952, the Union or State Government may select one Notary Public for a province or the entire country or a complete state or a portion of the state.

Responsibilities of a Notary public are administered by the Notaries Act, 1952, and they are as follows-

  • Approve, attest or verify any document or instrument
  • Control oaths or observer swearing by deponents for affirmations
  • To give interpretations and check such versions of legal records from one language to another
  • To tape proof/evidence in criminal or civil lawsuits and to act as agent if so organized
  • To execute the role of a mediator, mentor or judge

Importance Of Notarization

Notary Rules, 1956 directs that each notary must practice a definite circular seal of the broadness of 5 c.m. showing the title of the person, the jurisdictional place in which he/she has been elected to execute his/her duties.

The Notarial Seal serves as a seal of confirmation indicating that the facts stated and the names on the paper are certainly authentic. It also acts as validation for the point that the names of the personalities approving the paper have been tested. It supports to check fraud and is an example of the leading ways related to avoiding fraud in constitutional records.
